Terms of use — tenStampd

Who we are

tenStampd is operated by DelTeQ Web Services (Pty) Ltd (registration number 2021/671559/07), of 1A Pagoda Street, Salisbury Park, Gqeberha, Eastern Cape, 6070, South Africa. In these terms, “we” and “us” mean that company, and “you” means whoever is using tenStampd.

What these terms cover

These terms apply to the tenStampd app on iOS and Android, to the web app at app.tenstampd.co.za, and to this website. Using any of them means you accept these terms. If you do not accept them, do not use tenStampd.

How we handle personal information is set out separately in our privacy policy, which forms part of these terms.

What tenStampd is

tenStampd is a digital loyalty card. Shops design a stamp card or a points programme, their staff record stamps at a counter, and customers hold the resulting cards in the app.

We provide the software. We do not provide the rewards. The offer on a card — a free coffee, a tenth wash, whatever a shop has set — is a promise made by that shop to its customer, and it is that shop’s to honour, to change or to withdraw. We are not a party to it.

Your account

You need an account to use tenStampd. When you create one:

Give accurate details, and keep them current.
Keep your password to yourself. You are responsible for what happens under your account.
Tell us promptly if you think someone else has got into it.
Do not create an account for anyone else, or let anyone else use yours.

If you are under 18, you may use tenStampd only with your parent’s or guardian’s permission. See the privacy policy for what POPIA requires here.

Shops, customers and staff

A shop that runs a programme on tenStampd is responsible for it. That includes:

What the reward is, and honouring it when a card is full.
The accuracy of what its staff record at the counter.
How it treats the customer details it can see, and complying with POPIA in respect of them.
Its own employees — rosters, hours, pay rates and counter PINs are the shop’s records, kept in our software.

A customer’s relationship over a reward is with the shop, not with us. If a shop closes, changes its programme or refuses a reward, that is a matter between the customer and the shop.

Acceptable use

Do not:

Use tenStampd to break the law, or to help anyone else do so.
Record stamps that were not earned, or otherwise falsify what happened at a counter.
Try to reach an account, card or record that is not yours.
Probe, scan or interfere with the service, or try to get around its security or rate limits.
Copy, resell, reverse-engineer or build a competing service out of the software, except to the extent the law says you may despite this term.
Upload anything unlawful, or anything you do not have the right to upload — including a logo or a photograph.
Use the messaging and promotional features to send anything a recipient has not consented to receive, or anything that breaches South Africa’s direct-marketing rules.

We may suspend or close an account that breaches these terms.

Buying through the App Store or Google Play

Shop subscriptions are bought as in-app purchases through the Apple App Store or Google Play.

Those stores take the payment, not us. We never see or hold your card details. We are told which plan is active, when it renews and whether it is in a trial.
Your purchase is also governed by the standard terms of whichever store you bought it from. Where those terms and these ones differ about the purchase itself — billing, refunds, renewal — the store’s terms apply to it.
Subscriptions renew automatically until cancelled.
Only the store can cancel a subscription. Cancel it in your Apple or Google account settings. Deleting your tenStampd account does not cancel it, and the billing carries on until you do — see delete your data.
Refunds are handled by the store under its own policy.
Prices shown on this site are in Rand, per month, VAT included. We may change them; a change takes effect at your next renewal, and the store will tell you before it does.

Customers are never charged for tenStampd, and are never asked for payment details.

Free trial

Where a free trial is offered, it runs for the period stated at the time and converts to a paid subscription at the end unless you cancel it in the store first. One trial per account.

Your content

You keep ownership of what you put into tenStampd — your shop’s logo, your card design, your photographs, the feedback you leave. You give us permission to store, display and process it for the purpose of running the service, and for no other purpose. That permission ends when the content is deleted.

You are responsible for having the right to upload whatever you upload.

Our software

The tenStampd app, this website, the tenStampd name and the tenStampd mark are ours. Nothing in these terms transfers any of it to you. You get permission to use the app as it is meant to be used, and nothing more.

Availability

We try to keep tenStampd running and correct, but we do not promise it will be uninterrupted or error-free. We may change features, and we may take the service down for maintenance. Where a change is significant we will tell you in the app before it takes effect.

Nothing here is professional advice. The statistics, heatmaps and payroll figures the app produces are calculated from what was recorded in it; they are a reporting tool, not accounting or legal advice, and you should check them before relying on them.

Ending it

You can delete your account at any time from inside the app — see delete your data for exactly what goes and what is kept.

We may suspend or end your access if you breach these terms, if we are required to by law, or if we stop offering the service. If we stop offering the service, we will give you reasonable notice and a way to get your data out.

Liability

To the fullest extent the law allows:

tenStampd is provided as it is. We do not give warranties beyond those the law implies and does not permit us to exclude.
We are not liable for indirect or consequential loss, for lost profits, or for loss of data that you could reasonably have kept a copy of.
We are not liable for a shop’s decisions about its own loyalty programme, or for a reward a shop does not honour.
Where we are liable, our total liability to you in any twelve-month period is limited to what you paid us for tenStampd in that period. For customers, who pay nothing, that means we are not liable for money.

Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008 or any other law that cannot be excluded by agreement. Where a term here conflicts with such a right, that right prevails and the rest of these terms stay in force.

Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction over any dispute about them.

Changes to these terms

If we change these terms we will update the date at the top, and where the change is significant we will tell you in the app before it takes effect. Carrying on using tenStampd after a change means you accept it.
